Jaipur: The Rajasthan High Court has quashed the Rajasthan Police’s rejection of a compassionate appointment claim by the legally adopted son of a deceased head constable, calling out the authorities for denying the job without giving “even a single reason”.Justice Ganesh Ram Meena, in a July 7, 2026 order uploaded on Tuesday, set aside the March 2, 2023 communication issued by the office of the Director General of Police rejecting Ashwani Gurjar’s claim. The court imposed ₹1 lakh costs on the respondents and directed them to reconsider his case and grant him compassionate appointment if he meets the eligibility conditions.The case arose after Head Constable Jai Hanuman Gurjar died in service on Jan 27, 2022. Ashwani Gurjar, his adoptive son, applied for compassionate appointment under the Rajasthan Compassionate Appointment of Dependents of Deceased Govt Servants Rules, 1996. The DGP’s office rejected the claim, saying only that he did not fulfil the requirements under the rules, without specifying which condition he failed to meet.“The court has directed the respondents to consider his case and grant him compassionate appointment, subject to his fulfilling the requisite qualifications for the post to which he is entitled under the Rajasthan Compassionate Appointment of Dependents of Deceased Govt Servants Rules, 1996. The entire exercise has to be completed within 60 days from the receipt of the certified copy of the order,” said Akshay Yadav, counsel for the petitioner.Yadav argued that Ashwani was the legally adopted son of the deceased govt servant. He said the adoption deed was executed in 2007 according to community customs and registered on June 10, 2020, well before Jai Hanuman Gurjar’s death.Justice Meena observed that the respondents failed to give any reason for the rejection — in the order, in their pleadings or even during arguments before the court — and held that administrative authorities cannot reject compassionate appointment claims mechanically.
