Ajmer: The civil court (west) here Saturday rejected applications from the Union ministry of minority affairs and Archaeological Survey of India (ASI) to dismiss the Hindu Sena’s lawsuit claiming a Shiva temple beneath the dargah of Khwaja Moinuddin Chisti. The court initiated the hearing on the lawsuit and then adjourned the matter to Nov 1.The Union ministry of minority affairs had asked the court to dismiss the lawsuit, arguing that the plaintiff had not made the Union govt a party in the lawsuit. Its application also raised the issue of the applicant, who filed the lawsuit as President of Hindu Sena, and demanded the registration of the organisation and proof that the applicant was the president of such an organisation.Similarly, the ASI filed an application for dismissal of the lawsuit, claiming that the lawsuit had not disclosed in which part of the dargah the temple survived. The application also stated that the lawsuit had not disclosed what types of temple relics were found in the dargah and in which part of the premises. After hearing arguments, the court dismissed the applications of both and proceeded with the main application filed by the Hindu Sena’s president, setting the next date of hearing as Nov 1.The lawsuit was filed in Sept last year, and the court issued notices on Nov 27 to ASI and the ministry of minority affairs. Meanwhile, 11 more parties came forward to become parties in the lawsuit. The 38-page lawsuit claims that there is a temple beneath the Ajmer dargah and cited proof in the form of a book published in 1911.
