Raj HC grants bail, faults cybercrime probe

Jaipur: The Rajasthan High Court has granted bail to two accused in a cybercrime case, sharply criticising the Investigating Officer for failing to submit a court-sought report on QR codes and UPI IDs linked to the alleged offence and appearing “hardly aware” of how such probes should be conducted.Justice Ravi Chirania made the observations while allowing the second bail applications of Sahil and Wajib in an order dated June 15. The court noted that the Investigating Officer had twice been directed to file a specific report on the QR codes and other UPI IDs allegedly connected to the case, but failed to comply.The judge recorded that the officer appeared to have little understanding of how a cybercrime investigation should be carried out.The court said the charge sheet had already been filed, the accused had remained in custody for a considerable period, and the trial was likely to take time. It granted bail without commenting on the merits of the allegations.Sahil and Wajib were arrested in connection with an FIR registered on Jan 30 at Nagar police station in Deeg district under provisions of the Bharatiya Nyaya Sanhita and Section 66D of the Information Technology Act. Their earlier bail pleas had been withdrawn with liberty to file fresh applications after the charge sheet, which was submitted on Feb 28.The High Court imposed strict bail conditions, including disclosure of all movable and immovable assets, bank accounts, UPI IDs, digital wallets and cryptocurrency holdings. The accused must also periodically submit transaction statements, not open new accounts without informing the Investigating Officer, and regularly appear before the police.The court warned that any breach of bail conditions or involvement in similar offences could lead to cancellation of bail.
