Divorce granted over wiferefusing physical relations

Jaipur: A family court in the city Wednesday granted divorce to a man on grounds of physical and mental cruelty, holding that his wife’s refusal to have marital relations for 15 years constituted a valid reason for the dissolution of marriage.According to advocate D S Shekhawat, the couple got married on Nov 3, 2003. The husband, who ran a travel agency, filed for divorce in 2021 after enduring years of emotional distress. He told the court that from 2003 to June 2018, his wife, a govt teacher, consistently refused to have any physical relationship with him and frequently picked fights, made false allegations of domestic violence and dowry harassment, and even threatened suicide on several occasions.In a detailed order, family court Judge Pawan Kumar Garg observed that the wife’s behaviour amounted to sustained physical and mental cruelty. The court also took note of the fact that the wife filed an FIR against the husband after he began divorce proceedings, a move the court said was an act of cruelty in itself.The court concluded that the marriage completely broke down and granted a decree of divorce in favour of the husband on the basis of cruelty and the irretrievable breakdown of the relationship.
