Jaipur: A single judge bench of Rajasthan High Court stayed the arrest of a petitioner against whom a case of criminal breach of trust and forgery was lodged at Jhotwara police station under sections of Indian Penal Code (IPC) instead of Bharatiya Nyaya Sanhita (BNS). The court asked the public prosecutor to correct the FIR to charges under BNS first.The petitioner, Amit Kumar, approached HC seeking quashing of the FIR against him on the grounds that it was almost a year since BNS was implemented in the state but police were still registering cases under IPC.Justice Sudesh Bansal asked the petitioner to appear before the investigating officer (IO) on July 7 or July 8 but instructed the police not to arrest him.“We questioned why the police are still registering the cases under IPC since BNS came into existence on July 1, 2024. He was also falsely implicated in the FIR,” said Raghav Mishra, counsel for the petitioner.tnn
