Jaipur: State’s department of personnel (DOP) has issued an order allowing women AIS officers and pensioners, as per directions of the Centre, to nominate their children for family pension ahead of their husbands in cases of marital discord, including ongoing divorce proceedings or cases under the Protection of Women from Domestic Violence Act, Dowry Prohibition Act, or IPC. The Ministry of Personnel, Public Grievances & Pensions has directed all states to implement this policy.
“The department of personnel and training, in accordance with the office memorandum dated Jan 1, 2024, issued by the department of pension and pensioners’ welfare, has decided that in cases where divorce proceedings involving a female member of service or female pensioner are pending in court, or if she has filed a case against her husband under the Protection of Women from Domestic Violence Act, the Dowry Prohibition Act, or the Indian Penal Code, the female member or pensioner may nominate her eligible child/children to receive the family pension after her death, prioritizing them over her husband,” the order stated.
“Additionally, the provisions of the office memorandum have been extended to members of the All India Services. Please take note and take necessary action, as applicable,” it added.
