Woman married under‘Nata Vivah’ entitled tofamily pension: Raj HC

Jaipur: The Rajasthan High Court has ruled that a woman married under the ‘Nata Vivah’ system — a form of contractual marriage traditionally prevalent among some communities in the state — is legally entitled to receive family pension after the death of her husband, reports Ashish Mehta.Allowing a writ petition filed by Ram Pyari Suman (60), a single bench of Justice Ashok Kumar Jain directed state authorities on Jan 16 to treat her as the lawful wife of deceased Puran Lal Saini, a retired govt servant, and release her pension under the Rajasthan Civil Services (Pension) Rules of 1996.The petitioner had approached the court after the department concerned refused to approve her pension following the death of Saini, a retired patwari, in 2020.
