SS stays Raj HC’s quashing of corruption FIR against RAS officer

Jaipur: A division bench of Supreme Court has granted an interim stay on Rajasthan high court’s decision to quash an FIR against RAS officer Bharat Bhushan in a corruption case. The court issued notices to the accused and state govt for their response. The RAS officer was charged with accepting bribe during his tenure as SDM, Shahpura.A bench of Justice MM Sundresh and Justice Satish Chandra Sharma gave the interim stay on a special leave petition filed by Sanjay Kumawat on Sept 8. The copy of the order was uploaded Thursday.“During his stint as SDM Shahpura, he was caught on April 3, 2016, for accepting a bribe of Rs 3.5 lakh in a land conversion case from complainant Kumawat. It was alleged that he demanded a bribe of Rs 35 lakh,” counsel for petitioner, Aditya Jain, said.Later, Bhushan challenged FIR against him and approached Rajasthan high court for quashing the ACB case.“Accused Bharat Bhushan challenged the FIR and Rajasthan high court quashed it on May 26, 2025. We have challenged this HC order and maintained there was evidence before ACB, which is important in Prevention of Corruption Act cases,” Jain added.Jain also argued that the complainant needed to appeal in SC because he was not made party in the FIR quashing petition and since the state govt did not challenge the high court order against action taken by its own investigating agency.
