Jaipur: The Supreme Court Tuesday declined to interfere with directions issued by Rajasthan High Court in 2018 to regulate public events and traffic movement around key institutional areas in Jaipur, including Amrudon Ka Bagh, Ambedkar Circle, and Janpath.A bench of Justice P S Narasimha and Justice Alok Aradhe disposed of petitions filed by Supreme Court-appointed Administrator, Justice Sudershan Kumar Mishra, and SMS Investment Corporation, which owns land in the affected area, challenging the HC’s directions. The apex court refused to set aside the HC’s orders but granted liberty to Rajasthan govt to pass appropriate statutory orders regulating or prohibiting traffic in the areas concerned within 8 weeks. The court also clarified that if state govt issues any fresh order, it would remain subject to judicial review. Rajasthan govt’s additional advocate general Shiv Mangal Sharma argued, “The HC’s directions were in public interest. The areas concerned are already declared silence zones and no-vending zones. The govt and police authorities are strictly complying with the order of the high court, and thus traffic in that area is smooth.” The matter traces its origin to suo motu proceedings by Rajasthan HC on Sept 5, 2018, after a large public gathering at Amrudon Ka Bagh caused severe traffic congestion, which reportedly prevented lawyers, litigants and even judges from reaching the high court on time.
