Jaipur: A single judge bench of the Rajasthan high court has annulled a 41-year-old termination order of a police constable by the police department. The court directed the police department to reinstate him in service until his retirement age and to provide salary and other retirement benefits from the date of termination. Justice Anand Sharma delivered the order on August 20 after hearing Ramesh’s petition. A copy of the order was uploaded Monday. “Prescribed procedure was not followed while dismissing the petitioner from services and rejecting his appeal. At the same time, he was also acquitted by the court in the same case from another court. In such a situation, his termination order and the order of the appellate officer are cancelled,” Justice Sharma said.In the petition, counsel Sandeep Bhagwati informed court that the petitioner was appointed as a constable in 1979. Following his appointment, a complaint was lodged claiming his real name is Mohan Lal and he secured the job by presenting his brother Ramesh’s documents. On the basis of this complaint, the police department suspended him in Jan 1984 and dismissed him in June 1984. His departmental appeal against the termination was also rejected in Nov 1984.Bhagwati contended that instead of a minor punishment under Section 17 CCA, the petitioner received a severe punishment of dismissal. “He was not heard. Additionally, a criminal case was filed against him on the same charges. He was acquitted in the criminal case on March 31, 2000. Later, in 2002, opposing his termination, he filed a petition at the High Court,” Bhagwati said.The state govt argued that the petitioner filed the petition after a delay of about 18 years. After considering arguments from both parties, the single bench ordered the cancellation of the dismissal order and the departmental appeal order, directing that the petitioner be reinstated in service until retirement.
