Jaipur: A Rajasthan high court single bench of Justice Anand Sharma has upheld a lower court decision to take cognizance against a doctor of a private hospital in a case involving the death of a newborn during delivery.Sodala police had initially filed a final report (FR) in the case on Dec 27, which a lower court rejected and sent the case for further investigation. It later took cognizance of a chargesheet filed by the CID’s crime branch following a re-investigation. The counsel for the doctor had argued in the high court for cancellation of the lower court’s cognizance.Opposing this, counsel for complainant Dinesh R Mehta argued that the doctor in question had no expertise in obstetrics and the hospital lacked both skilled staff and equipment necessary for a successful delivery.The complainant alleges that the doctor’s negligence led to the death of the newborn during delivery.In its order, the high court said the lower court made no error in rejecting the FR presented and taking cognizance of the CID chargesheet against the doctor.
