HC vacates interim stay on JMC firemen’s promotions

Times News NetworkJaipur: Rajasthan High Court has vacated the interim stay operating in a long-pending service dispute involving firemen of Jaipur Municipal Corporation, removing the legal restraint in the matter and allowing the petitioners to pursue their grievances before Rajasthan Civil Services Appellate Tribunal.Justice Ganesh Ram Meena passed the order on Sept 15 on a petition filed by Sanwar Mal Dodwedia and Sunita Devi Gurjar.The respondents included State of Rajasthan, the director of local bodies and Jaipur Municipal Corporation, besides several serving municipal firemen.The case arose from service-related grievances involving municipal firemen and issues connected with their seniority and promotions. The proceedings had remained pending before High Court, with an interim order operating during the course of the litigation.During the hearing, counsel for the respondents, Sidharth Jain Mutha, raised a preliminary objection to the maintainability of the writ petition, submitting that the petitioners had an alternative and expeditious remedy before Rajasthan Civil Services Appellate Tribunal.Following the submissions, the petitioners sought liberty to approach the Tribunal for redressal of their grievances.High Court accepted the limited request and disposed of the writ petition, granting the petitioners liberty to avail the appellate remedy before the Tribunal. Most significantly, court directed that “any interim order passed earlier shall also stand vacated.”
