Jodhpur: The Rajasthan High Court Friday directed that no coercive action be taken against Rashtriya Loktantrik Party (RLP) chief and Nagaur MP Hanuman Beniwal in connection with an FIR registered at Padu Kalan police station in Nagaur district.Justice Farjand Ali passed the interim order while hearing Beniwal’s petition challenging the FIR registered on May 28 under provisions of the Bharatiya Nyaya Sanhita (BNS) and Section 8B of the National Highways Act. The matter has been listed after three weeks.The FIR was lodged against Beniwal and 13 others in connection with a political gathering and procession held in Riyan Badi on Jan 6 against the alleged sand mafia.In its order, the court observed that the case required examination under its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). It said the issues for consideration included whether the allegations disclosed the essential ingredients of the offences, whether there were sufficient facts to establish individual criminal liability against Beniwal, and whether continuation of the proceedings would amount to an abuse of the legal process.The court granted the state three weeks to file its reply and directed that no coercive action be taken against Beniwal until the next hearing.
